Title: Enetertainment Attorneys not Probate Atty;s
Post by: letstalkagain on December 16, 2009, 04:19:08 PM
I was thinking but am I correct that Branca is an entertainment atty and not a probate atty.

I believe that MJ has a entertainment attorney handling his affairs instead of a probate attorney.
If I am correct then the hoax factor is staring directly at us.  I mean he dies an he uses a entertainment attorney, to handle his affairs.

Can anyone answer this question- Entertainment atty verses Probate atty for Branca ?

Great question, letstalkagain!

According to all that I've read, yes, Branca is an entertainment atty, and not a probate atty.  MJ's will appointed him as an executor of the estate...so does it matter if he's not a probate atty?  IDK enough about legal issues to answer this question.  Anyone?  (Maybe this is a question for our good friend, Harvey.)

I agree -- great question, letstalkagain.

And, no, it matters not a bit what kind of attorney Branca is, or if he's even an attorney at all. The fact that he's a lawyer is beneficial, though, because he knows many relevant things that non-lawyers probably don't.

A person who writes a will can name almost any adult to become an executor of their estate after they die or if they become incapacitated. As long as the person/people is/are competent, agree to take on the role, aren't contested, and get approved by the probate judge, everything is hunky dory.

Katherine and/or Joe could be executors of Michael's estate, as could any of Michael's siblings or adult acquaintances, *IF* he had named them as such in the will.

You're welcome, mjboogie. I'm a legal writer and lapsed paralegal, among other things, so I knew all of that off the top of my head, thanks to years of working 16-hour-or-so days in the field. But since you asked, here's what I dug up on a few reputable websites during a quick Google search:

Executor FAQ (http://estate.findlaw.com/probate/estate-administration/estate-administration-executor-faq.html)
Checklist: The Executor's Role (http://estate.findlaw.com/probate/probate-help/le28_8_1.html)
What Does an Executor Do? (http://www.nolo.com/legal-encyclopedia/article-30236.html)

Nice bedtime reading. Enjoy!

JERMAINE JACKSON: I found out from CNN. And I just said, I'm going to call my mother right -- right away. So I called my mother. She said she was on her way to the hospital. Within 45 minutes, past, Janet -- I spoke to Janet and I spoke to our attorney, Joel Katz. And the next thing I knew, I called my mother back and she -- just to hear her voice. She was at the hospital. She said, he's dead. And there was just a horrible tone in her voice.

why he spoke with this sttorney?
Joel Katz, Jackson's entertainment affairs attorney

Because lawyers are an entertainer's best friend, CC, provided they're ethical and competent.

Celebrities stay in close contact with their attorneys, especially during crises like the "death" of a relative who just happens to be the most famous entertainer around, because attorneys immediately know what to do to limit damage and protect their clients' interests. They also give great advice about all sorts of stuff, including and beyond legal issues.

When you're really famous or wealthy, calling your attorney when something "big" happens is like a reflex. Lawyers are almost like babysitters and/or counselors for some clients.

No problem. I'm not sure what you want elaborated, but the two main points here are:

(1) It doesn't matter that Branca is an entertainment lawyer and not a probate lawyer. He can still be the executor of Michael's estate.

(2) Certain Jackson family members called their lawyer after the news of Michael's "death" broke on June 25 because they trust their lawyer to give them good advice about what to do.

Hope that helps!
