A doctor in Los Angeles County has been charged with murder after three of her patients died of prescription drug overdoses.

Dr. Hsiu-Ying "Lisa" Tseng, 42, an osteopathic physician in Rowland Heights, Calif., allegedly wrote an average of 25 prescriptions per day over the last three years for addictive painkillers such as Oxycontin and Vicodin, with little regard for her patients' medical histories, according to ABC station KABC-TV in Los Angeles.

It's rare that a physician is charged with murder when a patient dies in connection with his or her treatment, according to James Acker, a professor at the School of Criminal Justice at the University of Albany, SUNY.

"Far more typically, although still unusual, is to charge a physician with criminal homicide," a lesser charge, he said.

For example, Dr. Conrad Murray was convicted of involuntary manslaughter for the death of his patient, the singer Michael Jackson.

More than 200 physicians have been arrested or convicted in connection with patients' prescription drug overdoses since 2003, according to the Drug Enforcement Agency.

"Where you are knowingly engaging in risky behavior, and it's likely that an adverse consequence such as a death will result, that's sufficient to consider it homicide," said Acker, who is not connected with the case.

Tseng was arrested Thursday and charged with murder in the deaths of Vu Nguyen, 29, of Lake Forest, on March 2, 2009; Steven Ogle, 25, of Palm Desert, on April 9, 2009; and Joseph Rovero III, 21, an Arizona State University student from San Ramon, on Dec. 18, 2009, KABC-TV reported.

Prescription painkiller overdoses killed nearly 15,000 people in the United States in 2008, three times as many people as were killed by painkiller overdoses in 1999, according to a report from the Centers for Disease Control.

Many young people believe that prescription drugs are "much safer" than illegal drugs, according to the Drug Enforcement Administration.

In fact, some 7 million Americans aged 12 years and older reported in 2009 that they'd abused prescription drugs for non-medical purposes within the past month, a 13 percent increase from the 6.2 million who did so in 2008, according to the DEA.

Los Angeles District Attorney Steve Cooley told KABC-TV that Tseng was prescribing medication that "was probably not needed at all, to feed someone's habit."

Undercover officers from the Drug Enforcement Administration had been posing as patients and investigating her practice for the last few years, while she was writing some 27,000 prescriptions starting in Jan. 2007, reported KABC-TV.

KABC-TV said the DEA suspended Dr. Tseng's license to write prescriptions in 2010, and she eventually surrendered her license to the Osteopathic Medical Board of California's Department of Consumer Affairs.

She is being held on $3 million bail and is scheduled to be arraigned on March 9, when she'll face some 21 other felony counts, including alleged fraud for prescribing drugs without a legitimate purpose, KABC-TV said.

Her husband, also a doctor, continues to run her clinic in Rowland Hills, reported KABC-TV. An assistant who answered the phone at the clinic said that Tseng's husband was not there and would not respond to ABCNews.com's request for comment.

Tseng's attorney, Peter Osinoff of the firm Bonne, Bridges, Mueller, O'Keefe & Nichols, did not immediately respond to a request for comment.

Methadone is commonly known for treating withdrawal symptoms from heroin addiction, but the drug is also prescribed for pain. Health officials say most of the overdose deaths are people who take it for pain - not heroin or drug addicts.

According to the CDC, methadone carries more risks than other painkillers because levels build up in the body and may interfere with a person's normal heart rhythm or breathing.

For the CDC's latest Vital Signs report, researchers analyzed rates of fatal methadone overdoses and sales from 1999 to 2010, and compared with 2009 data for other major opioid overdose rates from 13 states.

The report showed that deaths from the drug have been on the rise for years as more prescriptions have been filed. The CDC says six times as many people died of methadone overdoses in 2009 compared to death rates from 1999. The new report also finds four of every 10 overdose deaths from a single prescription painkiller involve methadone, twice as many as any other prescription.

"Deaths from opioid overdose have increased four-fold in the past decade, and methadone now accounts for nearly a third of opioid-associated deaths," CDC Director Dr. Thomas R. Frieden, said in a written statement. "There are many safer alternatives to methadone for chronic non-cancer pain."

The rise in deaths even prompted a 2006 warning from the Food and Drug Administration regarding careful prescribing of the drug.

One of the problems is that the majority of methadone prescriptions are written by practitioners who typically aren't trained in pain management, the CDC said. Methadone is sometimes inappropriately prescribed on a long-term basis for common causes of pain such as back pain, but the CDC says the benefits of opioid pain relievers for such uses are unproven.

Fortunately since the rapid rise, the rate of methadone-related overdose deaths appears to have peaked in 2007 at 1.8 deaths per 100,000 people, the report found. Since then, death rates have declined in parallel with the amount of methadone being distributed in the U.S. between 2008 and 2009.

To further curb overdose rates, the CDC says insurance companies should not list methadone as a preferred drug for treating pain. Other measures the agency recommends when prescribing the drug include, screening for substance abuse and other mental health problems, prescribing only the quantity needed based on duration of pain, using patient-doctor agreements along with urine drug tests for patients taking the drug long-term, educating patients on safe use and storage of the drug and providing tips on how to prevent and recognize overdoses.

This 'news' made people THINK and question :suspect:.., I think that MJ's death case was a start and motivator for further investigation on painkiller drugs prescriptions.
The article you posted is an example and I do hope that there will be more of these charges with the clear message to physicians, who are 'addicted' to prescribing painkillers, that they are considered to be a criminal.

To be honest I do not remember specifically metadoma found MJ's house, but again the result of autopcia.
What is the idea then? methadone leave the house to set a precedent in the investigation? If so,  :th_bravo: MJ.

(CBS News) Pharmaceutical giant GlaxoSmithKline will plead guilty and pay $3 billion in the largest settlement of health care fraud in U.S. history, the Justice Department announced Monday.


The settlement will resolve criminal and civil liability from the company's unlawful promotion of certain prescription drugs. The company is to plead guilty to a three-count criminal information, including two counts of introducing misbranded antidepressant drugs Paxil and Wellbutrin to interstate commerce and one count of failing to report safety data about the diabetes drug Avandia to the FDA. The criminal complaints will total $1 billion.

GSK will also pay $2 billion to resolve civil liabilities relating to Paxil, Wellbutrin and Avandia, as well as other drugs and also resolves allegations of pricing fraud.


The Justice Department said GlaxoSmithKline unlawfully promoted Paxil for treating depression in patients under 18 without FDA approval for pediatric use. The U.S. also alleged the company published and distributed a misleading medical journal article misrepresenting the drug's efficacy in treating depression in adolescents, also sponsoring dinners, spa programs and other activities to promote that use.


The Justice Department also contends that in 2003, GSK paid millions to doctors to promote Wellbutrin, approved at the time for depression, for off-label uses by funding meetings, sometimes at lavish resorts.


For Avandia, the U.S. alleged GSK failed to report certain safety data between 2001 and 2007 that have since led to "black box" warning labels of about the drug's potential to increase risk for heart failure and heart attack.


"Today's multi-billion dollar settlement is unprecedented in both size and scope. It underscores the Administration's firm commitment to protecting the American people and holding accountable those who commit health care fraud," James M. Cole, deputy attorney general, said in a statement. "At every level, we are determined to stop practices that jeopardize patients' health, harm taxpayers, and violate the public trust - and this historic action is a clear warning to any company that chooses to break the law."


The settlement marks the end of an extensive investigation involving the FDA, FBI and Department of Health and Human Services.

"Today brings to resolution difficult, long-standing matters for GSK," CEO Sir Andrew Wittey said in a company statement. "Whilst these originate in a different era for the company, they cannot and will not be ignored. On behalf of GSK, I want to express our regret and reiterate that we have learnt from the mistakes that were made."  "

The doctor's are only as good as the information they receive about the studies; false information leads to dangerous practice and children end up being guinea pigs for the corporations. Disgusting.

My doctor has tried to first give me samples of new drugs from the pharmas on several occasions with the explanation that it “might” help with this or that.  When asked why she would prescribe a medication on thought it “might” help her reply was, well you say what you’re doing now is not working so why not try something new.  When asked what she knew about the drug her reply well it’s been through trials and then she’d go to reading off the label.  :WTF: Truth is she didn’t know anymore about it than I did.  Yet she wanted to have me try it out. That is scary!

This falls right into the lap of our conversatin on yesterday.  We should all be very concerned when accepting prescriptions supposedly written to aid in our healing but actually being dispensed to put money into the pockets od big pharma & its supporters.

In June 1999, popular radio personality Dr. Drew Pinsky used the airwaves to extol the virtues of GlaxoSmithKline PLC's antidepressant Wellbutrin, telling listeners he prescribes it and other medications to depressed patients because it "may enhance or at least not suppress sexual arousal" as much as other antidepressants do.

But one thing listeners didn't know was that, two months before the program aired, Dr. Pinsky—who gained fame as "Dr. Drew" during years co-hosting a popular radio sex-advice show, "Loveline,"—received the second of two payments from Glaxo totaling $275,000 for "services for Wellbutrin."

The payments, made by a communications firm working for Glaxo, are revealed in an attachment to a complaint the U.S. government filed in October 2011 in federal court in the District of Massachusetts. The documents were disclosed this week as the U.S. Justice Department announced a $3 billion criminal and civil settlement with Glaxo over illegal drug marketing and other matters.

Asked about the radio program and the payments, Dr. Pinsky said in an emailed statement Tuesday: "In the late '90s I was hired to participate in a two-year initiative discussing intimacy and depression which was funded by an educational grant by Glaxo Wellcome," one of the companies that later merged to form GlaxoSmithKline. He said that the campaign "included town hall meetings, writings and multimedia activities in conjunction with [a] patient advocacy group." He added, "My comments were consistent with my clinical experience."

The U.S. government complaint against Glaxo followed a nine-year investigation of the company's marketing practices, and led to the settlement announced this week. As part of the deal, Glaxo is pleading guilty to criminal charges related to illegal drug marketing and failing to report important drug-safety data to the Food and Drug Administration.

The $3 billion fine will also settle the government's civil claims against Glaxo, including allegations that the company plied doctors with cash and lavish trips to resorts to get them to promote Glaxo drugs for uses beyond those specified in the drugs' FDA-approved prescribing labels.

Doctors are allowed to prescribe drugs as they see fit, but it is illegal for companies to promote drugs for uses not approved by the FDA, a practice known as "off-label" marketing. Wellbutrin's prescribing label doesn't state that the drug is less inhibiting of sexual libido than other antidepressants.

In an email Tuesday, Glaxo declined to answer questions about its financial relationship with Dr. Pinsky or other physicians.

The company said: "The complaint to which you refer concerns events in 1999, 13 years ago. It does not reflect what would be allowed in GSK today." It added: "The government has made many allegations and legal conclusions concerning Wellbutrin that GSK disputes. GSK admits, however, that during the period from January 1999 to December 2003, there were some occasions on which certain GSK sales representatives, speakers, and consultants promoted its antidepressant Wellbutrin to physicians for uses which were not FDA-approved in violation of federal law."

Dr. Pinsky is only one physician mentioned in the U.S. government's complaint. It also accuses a number of other doctors of taking large payments from the drug maker and improperly plugging its drugs, including one doctor who received $2 million from Glaxo between 2001 and 2003.

The complaint says the physician, James Pradko, gave hundreds of talks to doctors and Glaxo sales reps about depression and frequently made "off-label claims" about Wellbutrin's effectiveness against a number of conditions for which it isn't FDA-approved, including weight loss, chronic fatigue syndrome, erectile dysfunction and chemical dependencies.

In a phone interview Tuesday, Dr. Pradko said the complaint takes his speeches "very much out of context." He said he only ever spoke about treating depressed patients, and that his talks "weren't meant to sell drugs, ever."

He added: "During my numerous lectures I tried to answer a common question which many doctors have: How does a doctor choose one specific antidepressant medication for a certain patient from the many excellent medications available? The vast majority of doctors attending my lectures stated that they felt I answered this question and did so in an unbiased and scientifically sound manner."

On his 1999 radio appearance, Dr. Pinsky spoke at length about depression's damaging effects on relationships and intimacy. He describes antidepressants as a "cornerstone" of treatment but also calls therapy crucial and notes that antidepressants can cause people to lose interest in sex.

He also gives a plug for a website, www.intimacyanddepression.com (http://www.intimacyanddepression.com), where he says listeners can get information about town-hall meetings being organized for depression experts to talk to the public about the illness. That website today redirects to a Wellbutrin site—www.wellbutrinxl.com—established by GlaxoSmithKline. Web registry records show that Glaxo also established www.intimacyanddepression.com (http://www.intimacyanddepression.com) in 1999. A Glaxo spokesman declined to answer questions about www.intimacyanddepression.com (http://www.intimacyanddepression.com) or about the town-hall events Dr. Drew referred to.

In his radio appearance, Dr. Pinsky says he participated in some of the town-hall meetings in New York, San Francisco and Seattle but doesn't mention any connection to Glaxo.

"It was a very neat event. We go into big halls, three or four thousand people and you sit down with some really exceptional people who themselves are high power professionals in the field of the treatment of depression," Dr. Pinsky says.

In his email Tuesday, Dr. Pinsky sent a link to a cached version of www.intimacyanddepression.com (http://www.intimacyanddepression.com), and called it a website associated with the campaign he had been paid to help carry out. The site features a photo of Dr. Pinsky and a message from him that says, among other things: "Some of the most prescribed antidepressant medications can have a negative effect on a couple's sex life. However, couples should know that there are other effective antidepressants that do not disrupt sexual desire and function, and that partners should not have to tolerate sexual side effects." The site also includes details about the town-hall meetings, and notes that the program is sponsored by an educational grant from Glaxo.
