No obstacle to process the Vatican.

The Holy See had submitted a appeal at the Appeal Court .
The Holy See had invoked entitled to immunity of sovereign states,  on which even the administration Obama was in favor.

Washington - The Vatican is civilly liable for the acts of a priest accused of child abuse after that the U.S. Supreme Court refused to rule on the right to immunity of the Holy See.
Choosing not to comment on the action of the Vatican in the case of a pedophile priest Oregon, the supreme court upheld the U.S. previous decision of a Court of Appeals to waive the immunity Holy See.
It was precisely this that had prompted the decision Vatican to go to the Supreme Court, which is now refusing to deal the case, made the final decision of the Court of Appeal.
Before a representative of the Vatican may be called to testify, the court must decide whether the Vatican itself can be considered "Employer" of the priest abuser.

The case originated in the complaint of a victim, at the time fifteen, against an Irish priest, the Rev. Andrew Ronan - died in 1992 - that in '65 he molested him in Portland, Oregon. Earlier the priest had been involved in similar episodes in Ireland and in Chicago.
The victim then accused the Vatican not to be reduced to the lay state, the religious, or not have at least punished or removed.
The Holy See had submitted a appeal against the complaint   invoking immunity  for sovereign states.

In spring, when he filed an appeal, the Supreme Court sought the opinion of the U.S. government, whose opinion was that the Holy See enjoyed immunity in this case and that its leaders, first of all the Pope, could not be questioned. But the right to immunity he was dismissed over a number of instances to Court of Appeals in Sacramento that there was sufficient evidence connection between Ronan and the Vatican to consider the priest a employee of the Holy See.

Now the Supreme Court, choosing not to comment on immunity, decided not to stop the lawsuit in which the Holy See is accused of repeatedly moved the priest from town to city despite repeated sexual harassment of minors.
Action Vatican considers the legal co-responsibility for his abuse because he
Ireland and then moved to Chicago to Portland despite aware of the charges against him.

"We thank the judges for the courage with which they left that the lawsuit go forward, "said Jeff Anderson, a lawyer that  accuses the Vatican.
"The Court's action is an answer to prayers of thousands of survivors of sexual harassment of priests, finally have a chance of getting justice, the possibility of close the wounds, "he added.

The Vatican's lawyer, Jeffrey Lena, would have preferred to solve
the issue in the Supreme Court, "but today's decision does not
means that we were mistaken in interpreting the law.
"Lena recalled that on this point the Obama administration had reason at the Holy See: "The courts of Washington have estimated that the
case did not deserve to be examined at their level for now.
