LOS ANGELES (KABC) -- Michael Jackson's father may be able to move forward with his wrongful death lawsuit against Dr. Conrad Murray.


Joe Jackson is seeking unspecified damages over the death of his pop star son.

Murray's lawyers tried to get the lawsuit dismissed, but Los Angeles Superior Court Judge Michael Johnson rejected those efforts Monday and will make his final decision Wednesday.

The ruling also criticizes the format through which the defense documents were drawn up, calling it "distracting and confusing" and adding the admonition, "Do not use this method in the future."

Joe Jackson initially filed a wrongful death claim against Murray in U.S. District Court last June 25. However, a judge declined to hear the case and said it should be brought in Superior Court.

The complaint alleges Murray was negligent in administering the powerful anesthetic propofol to Jackson and that he did not tell paramedics that he gave the singer the drug.

Meantime, jury selection is set to get under way this week for the involuntary manslaughter trial against Murray.

Murray has pleaded not guilty to a charge of involuntary manslaughter in connection with the singer's death.
